Bankruptcy/Creditors' Rights

We represent both debtors and creditors in federal and state courts in Maryland, Virginia and the District of Columbia, and have substantial experience in bankruptcy, insolvency and creditors' rights law as well as related fields such as banking and lending, secured transactions and real estate. Our attorneys make a point of monitoring any significant developments in both bankruptcy and commercial law, and lecture on such topics before various local and national associations.

Debtor Representation

This practice group represents a wide range of individuals and businesses in all aspects of bankruptcy and insolvency. Our clients range from small firms in Chapter 7 liquidation to large corporations in Chapter 11 reorganization, as well as individuals in Chapter 7, Chapter 11 and Chapter 13 proceedings. We also handle state insolvency proceedings, including assignments for the benefit of creditors and voluntary receiverships and help clients protect assets from creditors.

Creditor Representation

Because we represent debtors in bankruptcy, we have special insight into the workings of the bankruptcy process that enables us to maximize the amount of money that we can recover for lending institutions and other creditors. Our lawyers have initiated involuntary bankruptcy proceedings against debtors, and successfully prosecuted motions for relief from automatic stay and objections to the discharge of debts, determined the priority and validity of liens, and recovered fraudulent conveyances and preferential payments.

We also represent creditors in state court proceedings to obtain and enforce judgments. Our assistance allows clients to collect their money by filing liens, attachments, garnishments and other involuntary security devices.

In addition to businesses and individuals, we represent bankruptcy trustees and creditors' committees, and have ourselves served as trustees, receivers and assignees in state court insolvency proceedings.

Workouts

Our scope of work also includes helping lenders and borrowers structure out-of-court workouts that often avoid bankruptcy and state insolvency proceedings, and thereby maximize the value of assets.
