The Delaware Advantage/Update on Delaware Trust Laws
Paul Marcotte moderated a webinar titled “The Delaware Advantage/Update on Delaware Trust Laws and Creative Uses of Delaware Trusts in Cross-Border Planning” on Thursday, April 22, 2021 at 12:00 pm. The event was organized by STEP Mid Atlantic.
The panel provided an overview of recent legislative developments in Delaware impacting cross-border planning including trusts. They also reviewed some existing features of Delaware law that make this jurisdiction quite attractive in terms of establishing trusts or holding companies for foreign HNW persons.
The panel concluded by exploring through illustrative fact patterns various Delaware trust structures to accommodate inbound wealth transfers by non-US persons with objectives of creating a wealth transfer in a stable jurisdiction, minimizing the impact of US wealth transfer and income taxes, and incorporating favorable features of Delaware trust law.
